These Terms of Use govern access to and use of Breakthrough, an educational platform operated by Breakthrough Medical Solutions Ltd ("Breakthrough", "we", "us" or "our").
By creating an account, accessing or using Breakthrough, you agree to these Terms.
1. About Breakthrough
Breakthrough is a digital educational platform designed to support case-based learning, clinical reasoning, discussion and healthcare education.
The platform may include:
- interactive clinical cases;
- AI-powered interactions;
- simulated patients or scenarios;
- scoring and feedback;
- facilitator tools;
- educational analytics; and
- content created by educators or institutions.
Breakthrough is an educational product and not a healthcare service or clinical decision-support system.
2. Who can use Breakthrough
Breakthrough may be accessed through:
- a demonstration or trial account;
- an account authorised by a university or other organisation; or
- another arrangement approved by Breakthrough.
Individuals registering independently for a demonstration or trial must be 18 years or older.
An institution may authorise access for younger users where appropriate and where permitted by applicable law and its agreement with Breakthrough.
Institutional use may also be subject to a separate agreement between Breakthrough and the relevant organisation. If there is a conflict, that agreement will take priority for the institutional service.
3. Accounts
You must provide accurate information when creating an account and must keep your login credentials secure.
You are responsible for activity carried out using your account unless the activity results from a security failure for which Breakthrough is responsible.
You must not:
- share an individual account with another person;
- impersonate another person;
- access another user's account without permission; or
- attempt to bypass access controls.
We may suspend or restrict accounts where reasonably necessary to protect users, the platform or other organisations.
4. Educational use only
Breakthrough and all content made available through it are provided for education and training purposes only.
Breakthrough must not be used:
- to diagnose a real patient;
- to make treatment or prescribing decisions for a real patient;
- as a substitute for professional clinical judgement;
- as a substitute for applicable clinical guidelines, local policies or professional standards; or
- to provide emergency or other clinical care.
Users remain responsible for verifying clinical information against appropriate authoritative sources.
5. Artificial intelligence
Some Breakthrough features may use artificial intelligence.
AI-generated content can contain errors, omissions, inconsistencies or unexpected outputs and should be critically evaluated.
AI responses are provided as part of an educational simulation and must not be relied upon for real-world patient care.
Breakthrough does not guarantee that AI-generated content will always be complete, accurate or appropriate.
Educators and institutions remain responsible for reviewing and approving educational material where they use Breakthrough to deliver their own teaching.
6. Do not enter patient information
Do not enter real patient information into Breakthrough.
This includes:
- names;
- NHS or other patient identification numbers;
- dates of birth;
- contact details;
- photographs capable of identifying a patient;
- identifiable clinical records;
- correspondence;
- investigation results linked to a real individual; or
- any other confidential patient information.
Do not enter information derived from a real patient even where you believe it has been anonymised unless Breakthrough has expressly agreed to that use in writing.
Cases should use fictitious, synthetic or otherwise appropriately authorised educational information.
7. Educational scores and analytics
Scores, rankings, feedback and analytics provided through Breakthrough are educational tools.
Unless Breakthrough and the relevant institution expressly agree otherwise, they are not validated measures of professional competence and should not be used alone to make decisions relating to:
- academic progression;
- professional licensing;
- fitness to practise;
- employment; or
- clinical competence.
Institutions remain responsible for decisions concerning their students and learners.
8. Content created by users and institutions
Educators and institutions may be able to create, upload or modify cases and other educational material.
The person or organisation providing that content remains responsible for ensuring that they have the necessary rights and permissions to use it.
You must not upload content that:
- infringes another person's intellectual property rights;
- breaches confidentiality;
- contains unlawful material;
- contains prohibited patient information; or
- otherwise violates these Terms.
You or your institution retain ownership of original content you provide.
You grant Breakthrough the rights reasonably necessary to host, process, display and technically adapt that content for the purpose of providing and operating the service.
Breakthrough does not acquire ownership of an institution's educational cases merely because they are uploaded to the platform.
9. Breakthrough intellectual property
The Breakthrough platform and its underlying software, design, branding, interfaces, platform-generated materials and other proprietary elements belong to Breakthrough Medical Solutions Ltd or its licensors.
Except where expressly permitted, you must not:
- copy or redistribute the platform;
- reproduce proprietary Breakthrough content;
- reverse engineer or attempt to extract source code;
- scrape or systematically extract platform data;
- circumvent security or access restrictions;
- create a competing product using protected elements of Breakthrough; or
- use Breakthrough trademarks or branding without permission.
Nothing in these Terms transfers ownership of Breakthrough's intellectual property to you.
10. Acceptable use
You must use Breakthrough lawfully and responsibly.
You must not:
- interfere with or disrupt the platform;
- attempt unauthorised access to systems or accounts;
- introduce malware or harmful code;
- conduct automated scraping or excessive automated requests without permission;
- use the platform for fraudulent, abusive or unlawful activity;
- use AI functions to generate harmful or unlawful material;
- attempt to bypass usage or security restrictions; or
- use Breakthrough for real-world clinical decision-making.
We may investigate suspected misuse and take proportionate action, including restricting or suspending access.
11. Third-party services
Breakthrough may rely on third-party technology providers for functions such as hosting, authentication, communications and artificial intelligence.
Use of these providers may involve information being processed as described in our Privacy Policy and, where applicable, our subprocessor information.
We are not responsible for third-party websites or services that users independently access outside Breakthrough.
12. Platform availability
We aim to provide a reliable service but do not guarantee uninterrupted or error-free access.
We may temporarily restrict access for:
- maintenance;
- security;
- technical changes;
- service improvements; or
- circumstances outside our reasonable control.
During demonstrations, pilots and early-access periods, features may be changed, added or removed as the platform develops.
13. Changes to Breakthrough
We may improve, update or modify Breakthrough over time.
Where a change materially affects an institutional service, it will also be governed by the applicable agreement with that institution.
14. Our responsibility
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation.
If you access Breakthrough as an individual consumer, your statutory rights are not affected.
We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to exercise reasonable care and skill.
We are not responsible for losses resulting from:
- use of Breakthrough contrary to these Terms;
- reliance on educational or AI-generated content for real-world clinical care;
- information supplied by an institution or another user;
- unauthorised use of an account resulting from a user's failure to keep credentials secure; or
- circumstances outside our reasonable control.
We are not responsible for business losses suffered by an individual using Breakthrough solely as a consumer.
Liability relating to paid institutional services may be further addressed in the relevant agreement between Breakthrough and the institution.
15. Suspension and termination
We may suspend or terminate access where reasonably necessary if:
- these Terms are materially breached;
- the platform is being misused;
- there is a security risk;
- continued access could expose Breakthrough or another person to legal or regulatory risk; or
- an institution withdraws or terminates a user's access.
Where appropriate, we will take reasonable steps to notify the affected user or organisation.
Users may stop using Breakthrough at any time.
16. Privacy
Our collection and use of personal information is described in the Breakthrough Privacy Policy.
Users should review the Privacy Policy before using the platform.
17. Changes to these Terms
We may update these Terms as Breakthrough develops or where legal, regulatory or operational requirements change.
The current version will be published on our website with its effective date.
Where a material change significantly affects existing users, we will take reasonable steps to notify them.
18. Governing law
For business and institutional use, these Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction unless a separate institutional agreement states otherwise.
If you are using Breakthrough as a consumer, nothing in this section removes mandatory rights or protections available to you under the laws applicable where you live.
